Would I lose the trial? possibilities?
The lady that hit me with the metal cane showed up to court today and she wants trial. The city's transit company requested footage. The police and paramedics seen what happen. The police told me it was on camera. The lady threaten me and I dropped my stuff and said "what are you gonna do" Next thing you know she pulled out a metal cane and it hit me with it. I did not hit her back at all. She was arrested. After she threatened me and I did drop my stuff and ask what she gonna do. I was tired of her talking crap.
Could I lose this case? and how?

She was not old. She had a pontoon. I dont know the spelling. She was is 35 years old
It all depends on what's on the video. An important part of it is what you did to set the old woman off in the first place. It might just look like a regular fight. Since she's old the fact that she took a swat at you with a cane might not mean much. What might be worse is the fact is that you dared her to do something and she did. That could be construed as a fight and it won't look good for you. If you were politely minding your own business and the old woman was unreasonably harassing you then you might having something.
EDIT: Excuse me. If she's only 35 then that's a lot better for you. Her cane could be construed as a deadly weapon and she's young enough to seriously injure you. Again, the video is all-important.. If the woman is convicted of criminal assault then that makes a subsequent civil suit pretty easy for you. I suggest talking to a few personal injury lawyers ASAP. Your lawyer will want to follow the action in the criminal proceedings against he woman. You're the government's primary witness. Other witnesses will probably also be involved. If the woman is convicted then your attorney will light up like a pinball machine if she has money.
