Can a police officer prove in court that a person did not have his or her seat belt while driving?
My husband received a ticket the other day for not having his seat belt on. I was with him and he did in fact have it on. It was dark and the police officer must have glanced over at him and assumed he didnt have it on, but how can you argue with a cop?
It's your word against them. But they are sworn officer & they hold more credibility in court. Even when their wrong or lying.
Also maybe the officer had a dash board camera.
I once got a seat belt ticket after getting into a accident. They claimed I wasn't wearing it when they came to the scene of the accident. Once they got there I was unconsious & not wearing a belt. I ended up talking to the district attorney & got the ticket dropped. I explained the facts to him. At the time I had a shaved head. I rolled my truck end for end and the only cuts I had were on my face and arms. Nothing on my head. If I wasn't wearing my seatbelt I would have been bouncing around in the cab. Also one of my injuries were broke ribs. The ribs were broke right where the seatbelt crossed them.
So maybe talking to the district attorney is something you should consider. Tell him the facts.
