When is it legal for a police officer to use pepper spray on a citizen?
Obviously this question will probably differ from state to state and even in different localities. Recently there was a riot at James Madison University in Harrisonburg, Virginia and video shows non-violent protesters being pepper sprayed. The protesters were standing about 10 feet away from police in riot gear with their hands raised in peace signs. It is unclear what the protesters said to the police; however, after a few minutes a police officer sprayed the protesters where they stood. At what point does a police officer have the right to administer pepper spray and under what conditions?
You are right, it differs from place to place.
But as a rule of thumb, if a person is given a lawful order by an officer and that person refuses to obey the officer has the right to use reasonable force. Pepper spray is considered reasonable force in such an incident. And that is what it sounds like happened here. Protesters were ordered to disperse, and they refused. The police could physically arrest them, or use a less violent force such as pepper spray. Which would you rather see? Protesters being physically taken into custody and receiving injuries, or a little irritation from pepper spray?
